Labor law experts, often allied with trade unions, have voiced strenuous objections to the government's proposals to relax the statutory daily maximum working hours. These plans, outlined in the coalition agreement between the Union and SPD, may permit daily work periods beyond twelve hours, as reported by the Hugo Sinzheimer Institute for Labor Law (HSI) of the Hans-Böckler Foundation last Friday.

Extended work hours have been shown to pose cumulative risks to both mental and physical health, potentially leading to conditions such as burnout, strokes, or cancer, as well as increasing accident rates. Additionally, the compatibility between work and family life could face strain.

Behind this controversy lies a planned switch from a daily maximum working time to a weekly one in the future, as stated in the coalition agreement. As of now, the law prohibits daily work periods exceeding eight hours, with exceptions permitting up to ten hours under specific conditions. Federal Chancellor Friedrich Merz described this as a means to foster greater freedom for employees and businesses through increased weekly flexibility.

However, Amélie Sutterer-Kipping, labor law expert, expressed concern that an erosion of working hour regulations based on scientific findings in occupational medicine and labor research and disregard for social realities could lead to economic impracticality. Such deregulation might undermine labor market advancements over the past years in areas like employment numbers and overall working hours, while exacerbating health and demographic issues.

Record growth in employment rates and overall working hours is also attributable to increased female employment, according to the data.

Easing working hour constraints would necessitate substantial changes to labor legislation and regulations, potentially entailing complex and disputed adjustments to collective agreements and facing potential legal challenges from labor unions and employees.
