Lawsuit Filed Against Trump Administration for Modifications to Affordable Care Act Regarding Health Insurance Markets
In a significant move, a multistate coalition of attorneys general, led by California's Rob Bonta and including Washington's Nick Brown, has filed a lawsuit against the U.S. Department of Health and Human Services (HHS) and Centers for Medicare & Medicaid Services (CMS). The lawsuit challenges the final rule issued by the Trump administration, which is set to alter the Affordable Care Act (ACA) and related insurance exchanges.
The rule, slated to take effect on August 25, 2025, is estimated by the administration to cause up to 1.8 million people to lose their health insurance, while many others may face increased premiums and out-of-pocket costs. The rule also excludes coverage of gender-affirming care as an essential health benefit under the ACA.
The coalition argues that the rule is arbitrary, capricious, unlawful, and violates the Administrative Procedure Act (APA). They contend that the rule creates unnecessary bureaucratic barriers, making it harder for Americans to sign up for and maintain ACA coverage. The plaintiffs are seeking preliminary relief, including a stay, to prevent the rule from taking effect.
Washington state Governor Bob Ferguson, who is also a co-plaintiff in the lawsuit, emphasised the importance of affordable healthcare for all, stating that everyone deserves access to affordable healthcare. In light of the rule, Ferguson plans to fill some of the gaps left by the final rule, though this will come at a cost to taxpayers.
Pennsylvania Governor Josh Shapiro, along with other state leaders, is also supporting the lawsuit. Washington state, like other states, will stand with its partners across the country against the Trump administration's efforts to strip away people's health care.
The status of the lawsuit is currently active, with a request for injunction or stay to block the implementation of the Trump administration's rule pending judicial review.
