This practice, reminiscent of excessive surveillance practices historically banned by law, may bypass existing privacy laws through indirect means, such as purchasing data from third-party brokers.

Another issue is the lack of transparency and control. Police analytical tools often use AI to analyse and search data deeply, including live or recorded video feeds, with little public oversight. This expansion can lead to unauthorized or overly broad searches that include sensitive health information, without individuals' knowledge or consent.

The potential for discrimination and algorithmic bias is another significant concern. Sensitive mental health or substance use data can contribute to discriminatory profiling, especially if AI systems incorporate biased or incomplete information. As seen in facial recognition software, algorithmic errors and biases disproportionately affect certain groups, raising concerns about fairness and accuracy in policing decisions.
